Our Policies
Market in the Park-et runs smoothly because of our vending policies, and all of our amazing businesses agree to follow these rules. Failure to comply with Market in the Park-et policies can result in being barred from participating in future markets. So, read these carefully 🙂
Contact us with any questions, suggestions, and concerns…tions.
Eligibility
- Vendors must be located in, or based mostly in, Colorado.
- Vendors must provide tangible objects for sale at the market. No booths for future services (i.e. window installation) or awareness (i.e. political party).
- Vendors are not a MLM (Multi-Level Marketing), franchise, or bulk business.
Prohibited Items
The following items are prohibited from being sold at MitP. If you have any questions, please inquire before the event. Bringing prohibited items will result in disqualification from all future MitP markets.
- Weapons, including knives, guns, or replicas
- Federally regulated substances, including alcohol, tobacco, and THC
- Fast fashion (e.g., Shein, Forever 21, Cider, etc.) unless items are vintage (at least 20 years old). Up-cycled pieces using fast fashion materials are allowed, but we gently encourage pieces made with higher-quality materials, because fast fashion pieces tend to be poorly made.
- Copyrighted or licensed materials without permission or a proper license (this rule does not apply to secondhand goods)
Transparency in Vintage
Vintage dealers are required to properly mark any contemporary (modern) pieces, bootleg pieces, or knockoff pieces as such, so that it is clear to buyers that they are not getting a vintage piece. “Thrift” dealers must make it abundantly clear that the focus of their items is their second-hand nature, not necessarily “vintage.” Examples of this are tagging the era of an item on its price tag, or mentioning it to the customer verbally when they check out.
Businesses attempting to brand items as something that they are not will not be allowed back.
No A.I.
This market does not permit any products made with A.I.-assisted creation. We are attempting to feature local creators work that comes solely from their talents, abilities, and ingenuity. If A.I. plays a part in your creative process, this is likely not the right market for you. This rule does NOT apply to your logo and branding, although we do encourage you to not use A.I. for that either. We have a lot of talented people in our community and are more than happy to connect you to some of them if you need some creative collaboration.
Businesses found to be offering A.I. products will be asked to remove them for the event, and repeated offenders will not be back to the market.
We are an “A-Hole Free Zone”
Vendors are expected to act in a kind and professional manner during their time at the event. This includes treating staff, customers, fellow vendors with kindness and respect. If you are unable to be kind and professional, this is not the event for you.
Unacceptable behavior includes, but is not limited to:
- Sexual harassment
- Bullying
- Yelling or other aggressive behavior
- Cursing
- Hate speech
- Discrimination of any kind
Booth Space
At any of our indoor locations, your entire setup, including where you sit/stand, MUST fit into your assigned space. Chairs, tables, and hanger piles will not be permitted in walkways. Walkways must be kept clear to comply with Fire Marshal and ADA guidelines. In any of our outdoor locations, there is a little wiggle room depending on location, but we will be constantly monitoring walkways to make sure that patrons can safely shop, and that your neighbors are not being encroached upon. Staying in your lane is respectful to everyone around you.
Booth Sharing/Subletting
Only approved, registered vendors are permitted to set up at MitP. Vendors who wish to share a booth must either apply to vend together or receive prior approval. Vendor acceptance is non-transferable. Failure to obtain approval prior to the market may result in removal from future events.
You are NEVER allowed to send another brand to vend instead of you. We promote you. If you are sending someone else to tend to your booth for you under your brand, please let us know so that we can expect them, and make sure they get the essential event information.
Competing Music
Businesses are not permitted to play music during the event’s operating hours. MitP will provide music through overhead speakers. Any vendor found playing music during the event will be barred from participating in future events.
“Doubling Up” aka Streaming
Businesses will not do any auctions or streams on platforms like Whatnot, etc while at the market without proper permission.
Promotion of Events
The promotion of other markets is not allowed at MitP without prior approval. You are welcome to promote things like a class you teach, a non-market event you are hosting, your brick-and-mortar location, etc. If you are not sure if we’ll have an issue, ask us.
Theft
Shoplifting is not tolerated at MitP. Most instances of shoplifting occur because guests are unaware that they need to pay at each booth. We ask that businesses handle the situation by politely reminding guests to pay before leaving the booth. If the situation escalates, please call MitP organizers for assistance. Any business caught stealing from another booth will be removed from MitP and banned from future events.
Sales Tax
Any business in Denver is required to charge and remit sales tax. However, MitP is not responsible for this, and we will not be enforcing it. It’s up to you to decide if you will do that and file the proper paperwork. Sales tax in the city of Denver and the state of Colorado is a combined 9.15%.
Lateness/No-Shows
Businesses are expected to be set up completely by the start time of the event. Being late disturbs the flow of the patrons, as many of them start shopping early. Do not be late. Chronically late busineses may be barred from future markets.
Businesses are expected to stay for the duration of the event until the official end time. Leaving early is looked down upon by market makers and other vendors alike. Even if you have sold out of your product, you are expected to stay. Leaving early without proper communication with the market may result in being barred from future markets.
When businesses do not show up to the event, it results in organizers scrambling, a visual hole in the planned layout, and an empty space that many other businesses were enthusiastically ready to fill. We take no-showing very seriously. Don’t do it. If there’s any chance you might not be able to make it, letting us know as soon as possible goes a long way. People who no-show without communication will almost certainly not be back.
Exceptions to these policies are made for true medical and family emergencies, and significant weather events that we will all be dealing with together.
Weather
Weather conditions are always tricky for outdoor markets and we do our best to deal with them as best as possible on a case-by-case basis. But due to the way that the event is booked, we cannot reschedule or cancel the event due to adverse weather, and we cannot refund you the day of the event. The show will almost always go on. Please review our cancellation/refund policy, and contact us with any questions. Luckily, we haven’t had any truly difficult weather situations yet!
Canceling & Refund Policy
MitP puts effort into promoting its businesses. Please do not sign up for a market unless you are serious about doing it. If something happens and you have signed up but can’t attend:
- You can cancel up until a week before the event for a full refund of the space fee.
- If you need to cancel the week of the event, a refund can happen if, and only if, we find a replacement.
- If you need to cancel within 72 hours of the event, we cannot refund your booth fee. It is often too difficult to find a relpacement by that time. We are as reasonable as possible but this is a firm policy.
